Questions about neffyinSchools?
We have answers.
for schools
Will school nurses or others who administer epinephrine in emergencies be liable?
Each state differs regarding their “Good Samaritan Laws” - which provide legal protection for individuals who help others in an emergency situation. These laws may provide exemption from civil liability and outline specific requirements for training personnel, as well as how to obtain, maintain, store, and administer epinephrine. Many states include indemnification clauses that do not hold prescribers, pharmacies, or trained school staff responsible for any negative outcome in emergency situations, however in some states, the laws will need to be updated to reflect new products like neffy. You can find resources that pertain to your specific state here: https://www.foodallergy.org/our-initiatives/advocacy/food-allergy-issues/school-access-epinephrine
Does my state allow and/or mandate stock epinephrine in my schools? What about neffy specifically?
In 2013, the School Access to Emergency Epinephrine Act was signed. It encourages states to adopt laws requiring K-12 schools to have undesignated epinephrine on hand. While nearly every state has passed legislation or guidelines regarding stock epinephrine in schools, the rules differ by state. Some states require K-12 schools to stock epinephrine and other states allow schools to stock it. Currently, 49 states and Washington, DC have legislation in place to either require or allow schools to stock epinephrine. The specifics of each state's legislation, and ability to stock neffy specifically, may vary. To learn more please visit: Advocacy Groups
What if my state does not allow neffy in their stocking protocols?
If your state specifically doesn't allow for neffy yet, because stocking protocols have not yet been updated to reflect this product and/or route of administration (i.e. nasal spray), you may need to contact your state legislator to request an update. Many food allergy/anaphylaxis education and advocacy groups have information and resources on this topic that can be found here: Advocacy Groups
Is there anything I can do to prepare my school for this program prior to applying?
Yes. It is recommended that you take the following steps as soon as possible:
- Review your state legislation to ensure that your school is eligible to utilize neffy to meet the requirements of your stock epinephrine laws (if not, you may contact your state legislator or food allergy/epinephrine advocacy groups who can help provide educational resources). Also check on indemnity clauses, which may need updating.
- Identify school staff that need or want to be trained in using neffy.
- Ensure that your school protocols for the emergency administration of epinephrine are updated.
- Determine whether your state has a standing order that can be used for medical authorization, or if you need to identify a prescriber that can complete a standing order for a neffy prescription at your school. A medical authorization will need to be submitted with your application for the neffyinSchools program.
How can my school apply?
Once the program is launched, we will provide a link to the online application. Please check back at this site in January 2025. You can also follow ARS Pharma social media on LinkedIn and X, where we will share timely updates.
Due to the overwhelming interest and response, we are currently at capacity for the December 12 webinar about neffyinSchools. We will share details about recordings and additional webinars in January 2025 on our social media pages (LinkedIn and X). Please email CommunityPrograms@ars-pharma.com if you’d like to join the waiting list.
What happens when neffy expires?
All schools are eligible to submit a request for replenishment product when the product is used or when it expires.
for parents
If my school has stock epinephrine, does this mean that I don't need to provide epinephrine and/or my child does not need to carry it with them?
No. Stock epinephrine is intended for administration in case of emergency only (Example: A student presents with symptoms of a severe allergic reaction, but may not have been previously diagnosed and therefore does not have epinephrine prescribed). Students with an epinephrine prescription will still be required to provide their own epinephrine.
